§ 2-3-5 ISSUANCE, REFUSAL AND APPEAL.
   (A)   If the Clerk finds the application is made out in conformance with § 2-3-4 of this chapter and the facts stated therein are correct, he or she shall issue, upon posting of bond as may be required by § 2-3-8 of this chapter, a license and charge a fee as determined by § 2-3-7 of this chapter.

   (B)   If the Clerk refuses to issue a license, he or she shall endorse his or her reasons upon the application. The applicant then shall have a right to a hearing before the Council at its next regular meeting. The Council may reverse, modify or affirm the decision of the Clerk by a majority vote of the Council members present, if a quorum, and the Clerk shall carry out the Council’s decisions.
