432.205 STOP SIGNS ON PRIVATE ROADS AND DRIVEWAYS.

   (a)    The owner of a private road or driveway located in a private residential area containing twenty or more dwelling units may erect stop signs at places where the road or driveway intersects with another private road or driveway in the residential area, in compliance with all of the following requirements:

      (1)    The stop sign is sufficiently legible to be seen by an ordinarily observant person and meets the specifications of and is placed in accordance with the Manual adopted by the Department of Transportation pursuant to Ohio R.C. 4511.09.

      (2)    The owner has posted a sign at the entrance of the private road or driveway that is in plain view and clearly informs persons entering the road or driveway that they are entering private property, stop signs have been posted and must be obeyed, and the signs are enforceable by law enforcement offcers under State law. The sign required by this  paragraph,  where appropriate, may be incorporated with the sign required by Section 434.035(a)(2).

   (b)    Sections 416.01 and 432.17(a) shall be deemed to apply to the driver of a vehicle on a private road or driveway where a stop sign is placed in accordance with subsection (a) hereof and to a pedestrian crossing such a road or driveway at an intersection where a stop sign is in place.

   (c)    When a stop sign is placed in accordance with subsection (a) hereof, any law enforcement officer may apprehend a person found violating the stop sign and may stop and charge the person with violating the stop sign.

   (d)    As used in this section, and for the purpose of applying Sections 416.01 and 432.17(a) to conduct under this section:

      (1)    "Intersection" means:

         A.    The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two private roads or driveways which join one another at, or approximately at, right angles, or the area within which vehicles traveling upon different private roads or driveways joining at any other angle may come in conflict.

         B.    Where a private road or driveway includes two roadways thirty feet or more apart, then every crossing of two roadways of such private roads or driveways shall be regarded as a separate intersection.

      (2)    "Roadway" means that portion of a private road or driveway improved, designed or ordinarily used for vehicular travel, except the berm or shoulder. If a private road or driveway includes two or more separate roadways, the term "roadway" means any such roadway separately but not all such roadways collectively.

      (3)    "Owner" and "private residential area containing twenty or more dwelling units" have the same meanings as in Section 434.035.

432.21 RIGHT OF WAY OF FUNERAL PROCESSION.

   (a)   As used in this section "funeral procession" means two or more vehicles accompanying the cremated remains or the body of a deceased person in the daytime when each of the vehicles has its headlights lighted and is displaying a purple and white or an orange and white pennant attached to each vehicle in such a manner as to be clearly visible to traffic approaching from any direction.

   (b)   Excepting public safety vehicles proceeding in accordance with Section 432.19 or when directed otherwise by a police officer, pedestrians and the operators of all vehicles shall yield the right of way to each vehicle that is a part of a funeral procession.  Whenever the lead vehicle in a funeral procession lawfully enters an intersection, the remainder of the vehicles in the procession may continue to follow the lead vehicle through the intersection notwithstanding any traffic control devices or right-of-way provisions of this Traffic Code, provided that the operator of each vehicle exercises due care to avoid colliding with any other vehicle or pedestrian.

   (c)   No person shall operate any vehicle as a part of a funeral procession without having the headlights of the vehicle lighted and without displaying a purple and white or an orange and white pennant in such a manner as to be clearly visible to traffic approaching from any direction.

   (d)   If the offender commits the offense while distracted and the distracting activity is a contributing factor to the commission of the offense, the offender is subject to the additional fine established under Section 404.991 of the Traffic Code.  (ORC 4511.451)

432.22 DRIVING AND PARKING UPON SIDEWALKS, STREET LAWNS OR CURBS.

   No person shall drive, stand or park a vehicle, other than a bicycle, on a sidewalk, street lawn area of the curb of a street, except when entering or leaving a permanent or temporary driveway or when lawfully authorized. (Ord. 1969-54. Passed 7-7-69. )

432.23 DRIVER'S VIEW AND CONTROL TO BE UNOBSTRUCTED BY LOAD OR PERSONS.

   (a)    No person shall drive a vehicle when it is so loaded, or when there are in the front seat such number of persons, as to obstruct the view of the driver to the front or sides of the vehicle or to interfere with the driver's control over the driving mechanism of the vehicle.

   (b)    No passenger in a vehicle shall ride in such position as to interfere with the driver's view ahead or to the sides, or to interfere with his control over the driving mechanism of the vehicle. (ORC 4511.70)

432.24 DRIVING UPON STREET POSTED AS CLOSED FOR REPAIR.

   (a)   No person shall drive upon, along or across a street or highway, or any part thereof, which has been closed in the process of its construction, reconstruction or repair, and posted with appropriate signs by the authority having jurisdiction to close such street or highway.

   (b)   If the offender commits the offense while distracted and the distracting activity is a contributing factor to the commission of the offense, the offender is subject to the additional fine established under Section 404.991 of the Traffic Code.  (ORC 4511.71)

432.25 FOLLOWING AND PARKING NEAR EMERGENCY OR SAFETY VEHICLES.

   (a)   The driver of any vehicle, other than an emergency vehicle or public safety vehicle on official business, shall not follow any emergency vehicle or public safety vehicle traveling in response to an alarm closer than 500 feet, or drive into or park such vehicle within the block where fire apparatus has stopped in answer to a fire alarm, unless directed to do so by a police officer or a fireman. 

   (b)   If the offender commits the offense while distracted and the distracting activity is a contributing factor to the commission of the offense, the offender is subject to the additional fine established under Section 404.991 of the Traffic Code.  (ORC 4511.72)
