123.02 PARTICIPATION IN OHIO DEPARTMENT OF TRANSPORTATION CONTRACTS.

   (a)   Council hereby authorizes the City to participate in contracts authorized by Ohio R.C. 5513.01(B), and other related provisions of State law, in order for the City to purchase machinery, materials, supplies and other articles which the State contracted for pursuant to Ohio R.C. 5513.01(B).

   (b)   Council hereby authorizes the Mayor to agree in the name of the City to be bound by all terms and conditions that the State Director of Transportation prescribes.

   (c)   The Mayor is hereby authorized to agree in the name of the City to directly pay the vendor, under the contract of the Ohio Department of Transportation in which the City participates, for those items that the City receives pursuant to the contract.

   (d)   The City agrees to hold the Director of Transportation and the Ohio Department of Transportation harmless for any claim or dispute arising out of participation in a contract authorized by Ohio R.C. 5513.01(B).

   (e)   Council hereby finds and determines that the State law procedure referred to in this section substantially meets all of the requirements of public bidding which the City might otherwise have performed for itself, and that this alternate procedure under State law will provide the opportunity for the City to purchase such materials and supplies at prices lower than what might otherwise be expected had the City independently advertised and/or negotiated for such machinery, materials, supplies or other articles.
