660.21  RUBBISH COLLECTION.
   (a)    The Public Works Director is hereby authorized to establish rules and regulations for the pick-up of rubbish in the City. Copies of such rules and regulations shall be available at the City Hall.  Such rules and regulations shall include but not be limited to the following:
      (1)   The City shall establish a Senior/Disabled Rubbish Collection Program (“Program”) that will include, at a minimum, the following:
         A.   The Program shall be available to any City resident who is eighty (80) years or older and/or who has a disability that prevents the resident from physically participating in the City’s curbside rubbish collection program.  In order to qualify for the Program there must not be an able-bodied person living at the location of the collection.  All participants in the Program must otherwise be eligible for City rubbish collection.
         B.   In order for disabled residents of any age to participate in the Program, the resident must establish that they have a physical disability that prevents or seriously impairs their ability to carry, push or haul rubbish to the curbside.  Participants in the Program may be subject to an in-home evaluation and a note from a healthcare provider may be required.
         C.   The Program will allow participants to place their rubbish and/or recyclables (in the cart approved and provided by the City) near their garage door or other acceptable location by 7:30 a.m. the morning of their regular collection day and the City will collect the rubbish/recyclables and return the containers to the garage door.
         D.   The Law Director and Public Works Director shall establish an application, Right of Entry Agreement and such other rules and regulations as are necessary to carry out their Program.
         E.   The Program shall not apply to yard waste bags or other large items which must be placed at the curbside.
   (b)    No person shall:
      (1)    Place rubbish for collection prior to 6:00 p.m. of the evening preceding the day scheduled by the Public Works Director for collection;
      (2)    Allow empty containers or other uncollectible rubbish items to remain at their place of collection after 9:00 a.m. of the day following the day scheduled by the Public Works Director for collection; or
      (3)    Place rubbish or any other item for collection by the City which rubbish or other item was brought from another location for the purpose of obtaining City collection.
   (c)    Whoever violates any of the provisions of this section is guilty of a misdemeanor of the fourth degree. Punishment shall be as provided in Section 698.02. The Mayor's Court may establish a fifty dollar ($50.00) waiver for a first offense.
