A. When residential building plans are submitted to the village for review and approval they shall be forwarded to the code official for review. (See section 1.04.010 of this code for definition of "code official".) The submitted plans must also include the following:
1. Front elevation drawings of the homes to be constructed;
2. Photographs of the homes on either side and across the street from the subdivision.
B. The code official, during his/her review of the submitted residential building plans, shall ensure that the submitted plans conform to the requirements of the monotony code.
C. If the submitted residential plans conform to the requirements of the monotony code they shall be approved by the code official, for that portion of the building plan review. The code official shall maintain a file of all submitted plans and data submitted for review.
D. If the submitted residential plans do not conform to the monotony code they shall not be approved by the code official for that portion of the building plan review.
1. The code official shall explain the reason(s) for not approving the submitted residential plans with the person, or persons, originally submitting the residential plans to the village for review. The requirements of the monotony code will be explained. The code official shall maintain a file of all submitted plans and data submitted for review.
2. If during the explanation of the nonapproval of the submitted residential plans, the person, or persons, originally submitting the plans and the code official cannot resolve the reasons for the monotony code violation the matter will be referred to the Beach Park zoning board of appeals for a hearing and recommended resolution.
a. The recommendation of the zoning board of appeals shall be forwarded to the village board for their review and action.
b. The decision of the village board will be final and binding on all parties. (Ord. 1995-O-06 § 4)
