13.12.150: APPEAL OF NOTICE OF VIOLATION:
Any person receiving a notice of violation may appeal the determination of the AEA. The notice of appeal must be received within ten (10) days from the date of the notice of violation. The notice of appeal shall clearly and specifically state what portion or portions of the decision the appellant is appealing from. Failure to appeal with the required written specificity shall be deemed a waiver of those portions of the decision not specified.
The strict rules of evidence in effect in the circuit court shall not apply to the hearing. Hearing on the appeal before a hearing officer of the AEA, or other designated administrative body, shall take place within twenty (20) days from the date of receipt of the notice of appeal. The decision of the designated hearing officer shall be final from and after its issuance and the mailing or delivering a copy thereof to the appellant. An appeal hereunder or pursuant to the administrative review act shall not toll the effects of a continuing violation under the penalties provided herein. An appeal to the AEA, to be heard by the village, shall stay the enforcement of the order and penalty provided for in this chapter. An appeal pursuant to the administrative review act shall not stay the enforcement of any order and penalty provided herein. (Ord. 2008-O-27 § 1)
