13.04.090: FIRE SERVICE LINES; WHEN REQUIRED; REGULATIONS; PERMIT FEES:
It is unlawful for anyone to connect to the village water system a fire service line except in accordance with the provisions of this section.
   A.   Definition: "Fire service line", as used in this section, means the water pipe which is connected directly or indirectly to the village water supply system and which provides water solely as a fire suppressant through a fire suppression system required to be installed pursuant to the village building or fire codes, as amended.
   B.   Fire Service Line; Direct Connection: Except as provided in this subsection, all fire service lines shall be directly connected to the village main line. Such connection shall be independent from the water service line or lines which provide water for consumption at the premises so served. The fire service line or lines shall be utilized only for fire suppression systems. For limited area fire suppression systems, the village board may, upon the recommendation of the public works committee, grant an application for a variation from the direct connection requirements of this subsection.
   C.   Expense Of Design And Installation: All required fire and service lines shall be designed and installed at the expense of the owner of the premises to be served, or by the party seeking the building permit for the improvements required to have a fire service line or lines. Any other provisions of this title to the contrary notwithstanding, the owner of the premises served and in the case of industrial and commercial premises, the occupant of such premises, shall be jointly and severally responsible for the maintenance of the fire service line from the point of connection to the village main to and throughout the premises served.
   D.   Permit And Inspection Fees:
      1.   No fire service line shall be connected, directly or indirectly, to the village water system without there first being obtained a permit for such connection. The permit fee for the connection of the fire service lines to the village water system shall be as provided in the fee schedule of the village, as amended.
      2.   Fire service lines of diameters different from those as provided in the fee schedule of the village, as amended, shall be charged a permit and inspection fee, reasonably adjusted, as determined by the public works committee and the village engineer.
      3.   In addition to the connection fee, a permit inspection fee, as provided in the fee schedule of the village, as amended, per connection, shall be charged.
      4.   All connection and inspection fees shall be paid at the time of application therefor, and no permit to connect shall be issued or, if issued, be valid, until or unless all required connection charges and inspection fees are paid. Further, no permit shall be issued to a person who has failed to pay any fine, penalty or debt owing to the Village (“Village Debt”). A person whose permit application is rejected based on a Village Debt may appeal the decision, which appeal must be in writing and filed with the Village Clerk within ten (10) days following the decision. The written appeal must include the basis for contesting the Village Debt and other information that will help the applicant’s case. Within the body of the written appeal, the Applicant may also request a hearing to contest the Village Debt. The Village Administrator will set a hearing date within ten (10) days of the receipt of the written request for hearing and will rule on any appeals that are timely filed. If a timely written appeal is not filed, the Village Debt will be considered final.
   E.   Testing: All fire service lines shall be hydrostatically proof tested and disinfected in accordance with village regulations prior to the issuance of any applicable certificate of occupancy.
   F.   Other Codes Applicable: All fire service lines shall be designed, installed and maintained in accordance with all applicable village building and fire prevention codes. Should the provisions of this chapter conflict with any other code or regulation of the village, it is the intention of this chapter that the more strict code or regulation shall apply.
