12.04.090: RIGHT OF WAY AND PAVEMENT DEFICIENCIES; APPROVAL:
   A.   The right of way width in areas where the right of way has been platted but the road has not been built, may be approved at the existing right of way width.
   B.   In the above situation, if the roadway has been constructed, the village shall determine if any additional improvements should be made including providing aggregate base course and/or bituminous surfacing.
   C.   Right of way widths, road widths and cross sections in a proposed development which deviate from the standards noted in this chapter may be considered for approval at deficient dimensions; provided, that:
      1.   The proposed road is an extension of a deficient road; or
      2.   The proposed road intersects the deficient road.
   D.   The right of way width in no case shall be less than fifty feet (50'). (Ord. 2000-O-22 § 1)
