9.04.110: DISORDERLY CONDUCT:
A person commits disorderly conduct when he knowingly:
   A.   Does any act in such unreasonable manner as to provoke, make or aid in making a breach of peace; or
   B.   Does or makes any unreasonable or offensive act, utterance, gesture or display which, under the circumstances, creates a clear and present danger of a breach of peace or imminent threat of violence; or
   C.   Refuses or fails to cease and desist any peaceful conduct or activity likely to produce a breach of peace where there is an imminent threat of violence, and where the police authority has made all reasonable efforts to protect the otherwise peaceful conduct and activity, and has requested that said conduct and activity be stopped and explained the request if there is time; or
   D.   Fails to obey a lawful order of dispersal by a person known by him to be a peace officer under circumstances where three (3) or more persons are committing acts of disorderly conduct in the immediate vicinity, which acts are likely to cause substantial harm or serious inconvenience, annoyance or alarm; or
   E.   Assembles with three (3) or more persons for the purpose of using force or violence to disturb the public peace; or
   F.   Goes about begging or soliciting funds on the public ways, except as permitted by this code; or
   G.   Appears in any public place manifestly under the influence of alcohol, narcotics or other drug, not therapeutically administered, to the degree that he may endanger himself or other persons or property, or annoy persons in his vicinity; or
   H.   Carries in a threatening or menacing manner, without authority of law, any pistol, revolver, dagger, razor, dangerous knife, stiletto, knuckles, slingshot or other dangerous weapon, or conceals such weapon on or about the person or vehicle; or
   I.   If, in connection with any commercial enterprise, plays or transmits, or if in control of premises, permits, other amplifying devices to be played or transmitted over any loudspeaker such music or spoken words, so that the sound of such music or spoken words emanates beyond the boundaries of the originating premises and penetrates the walls or windows of any residence within the village to the annoyance or disturbance of the occupant or occupants thereof; or
   J.   For profit or as an incident to a commercial enterprise, sponsors or organizes or provides facilities for persons on his property a simultaneous congregation of fifteen (15) or more persons whose collective conduct or activity is such that the noise generated by such conduct or activity travels beyond the boundaries of the originating premises and penetrates the walls or windows of any residence within the village to the annoyance or disturbance of the occupant or occupants thereof; or
   K.   With intent to annoy, frighten or harass another, makes a telephone call to such other person and then and there threatens the physical safety of such other person, or without provocation, makes sexual advances to such other person, or makes only breathing and groaning sounds; or
   L.   Transmits in any manner to the fire department of the fire protection district a false alarm of fire, knowing at the time of such transmission that there is no reasonable ground for believing that such fire exists; or
   M.   Transmits in any manner to another a false alarm to the effect that a bomb or other explosive of any nature is concealed in such place that its explosion would endanger human life, knowing at the time of such transmission that there is no reasonable ground for believing that such bomb or explosive is concealed in such place; or
   N.   Transmits in any manner to the police authority, public officer or public employee a report to the effect that an offense has been committed, knowing at the time of such transmission that there is no reasonable ground for believing that such an offense has been committed; or
   O.   Enters upon the property of another without permission of the owner or occupant and for a lewd or unlawful purpose deliberately looks into a dwelling on the property through any window or other opening in it; or
   P.   Disturbs, tends to disturb or aids in disturbing the peace of others by violent, tumultuous, offensive or obstreperous conduct, and no person shall knowingly permit such conduct upon any premises owned or possessed by him or under his control. (Ord. 1993-O-23 § IV)
