8.12.180: PARKING OF VEHICLES AS A NUISANCE:
   A.   Nuisance Declared And Prohibited, 1-2 Family Residential Districts (Zones AG, E, SE, SR, R-1, R-2A, R-3A And R-3B): Except when necessary to avoid conflict with other traffic, or in compliance with the law or the directives of a police officer or village official or official traffic control device, it is hereby declared unlawful and a nuisance to stop, stand or park any vehicle on a privately owned, nonimproved surface, in districts zoned agriculture (AG), estate (E), suburban estate (SE), suburban residential (SR), single-family residential (R-1), single-family residential (R-2A), single-family residential (R-3A) and two-family residential (R-3B), regardless of whether the owner of the vehicle owns the private property or has permission of said owner of the private property.
      1.   Improved surfaces include (at a minimum):
         a.   Two inches (2") of class 1 bituminous paved surface on six inches (6") of compacted CA 6 grade 9 gravel base.
         b.   Four inches (4") of six (6) bag mix concrete with no. 10 six inch by six inch (6" x6") steel mesh on four inches (4") of compacted CA 6 grade 9 gravel base.
         c.   Concrete paver blocks or grid per manufacturers’ recommendation on one and one-half inches (11/2") bedding sand underlaid by six inches (6") of compacted CA 6 grade 9 gravel base.
         d.   Existing Parking Areas: An existing parking area that does not comply with the above standards may be utilized and maintained as described in Section 8.12.240.
         e.   Other hard or dust free paved surfaces as approved by the Building Official.
   B.   Nuisance Declared And Prohibited, Other Districts (Zones R-3C, R-3D, B-1, CS, O-1, OR And LI): Except when necessary to avoid conflict with other traffic or in compliance with the law or the directives of a police officer, village official or official traffic control device, it is hereby declared unlawful and a nuisance to stop, stand or park any vehicle on a privately owned, nonimproved surface, in districts zoned multiple-family residential (R-3C), multiple-family residential (R-3D), business district (B-1), commercial service (CS), restricted office (O-1), office research (OR) or limited industrial (LI), regardless of whether the owner of the vehicle owns the private property or has permission from the owner of the private property.
      1.   Improved surfaces include:
         a.   Concrete: Six inches (6") of six (6) bag mix concrete with no. 10 six inch by six inch (6"x6") steel mesh on eight inches (8") of compacted CA 9 gravel base.
         b.   Asphalt: Shall be in compliance with section 16.19.090, “Parking Lots And Driveways In Nonresidential Developments And Subdivisions”, of this code.
         c.   Paver Brick: Other hard or dust free paved surfaces as approved by the building commissioner.
      2.   Existing Parking Areas: An existing parking area that does not comply with the above standards may be maintained as described in Section 8.12.240.
   C.   Definitions: As used in this section, “vehicle” means a machine propelled by power other than human power designed to travel along the ground, water or air to transport persons, property or machinery, and shall include, without limitation, automobile, truck, trailer, motorcycle, tractor, boat, rowboat, kayak, aircraft, all-terrain vehicle, go-kart, sand rail, snowmobile, dune buggy, and recreational vehicle.
   D.   Penalty: Any person found guilty of violating, disobeying, or opposing the enforcement of any of the provisions of this section, upon conviction thereof, shall be fined not less than fifty dollars ($50.00) nor more than seven hundred fifty dollars ($750.00) per violation.
