6.06.120: DOGS, CATS AND OTHER ANIMALS RUNNING AT LARGE PROHIBITED:
   A.   No owner of a dog, cat or other animal shall cause or permit such dog, cat or other animal to run at large at any time during the year in any area of Beach Park. All dogs, cats and other animals kept within any area of Beach Park shall be controlled as defined within this chapter in such a manner so as to prevent the dog, cat or other animal from running at large. Any dog, cat or other animal found running at large in violation hereof is hereby declared to be a public nuisance and shall be apprehended and impounded in the manner provided in this chapter. However, if such dog, cat or other animal cannot be safely taken up and impounded, such dog, cat or other animal may be destroyed by the health department; provided further, that in all cases where such dog, cat or other animal has bitten or caused an abrasion of the skin of the person is so slain and a period of less than ten (10) days has elapsed since the day upon which such dog, cat or other animal bit or caused abrasion of the skin of any person, it shall be the duty of the person destroying such dog, cat or other animal to deliver the head and brain of such dog, cat or other animal to the health department immediately after such destruction.
   B.   It shall be unlawful for any owner to allow their animal(s) to cross outside the property line of its owner to any extent, including reaching over or under a fence, or to keep or allow their animal(s) to be outdoors in an unfenced portion of the owner's property, unless the animal is leashed and under the control of its owner or responsible person.
   C.   It shall be an unlawful failure to restrain, for an animal to attack, bite, threaten, or jump on any person without that person's consent on invited guests inside the property of the animal's owner or anyone outside the property of the animal's owner whether or not the animal is restrained unless that restrained animal is protecting the owner or other responsible person against unwarranted threatening conduct.
   D.   The provisions of this section shall be a positive duty of the owner and the offenses described herein shall be strict liability offenses.
   E.   Any owner who violates any provision of this section shall be subject to a fine of three hundred dollars ($300.00), if the violation does not result in a severe injury or death to any person or damage to another person's property. If the violation results in severe injury or death to any person, the owner shall be subject to a fine of not less than seven hundred fifty dollars ($750.00). In addition to a fine, the owner may be required to submit full restitution to the victim or may be incarcerated for a period not to exceed six (6) months, or may be required to perform up to one hundred (100) hours of community service, or any combination thereof. If the violation results in damage to another person's property, the owner shall be subject to a fine of not less than three hundred dollars ($300.00) and not more than seven hundred fifty dollars ($750.00). In addition to a fine, the owner may be required to submit full restitution to the victim. The village of Beach Park has the authority to disallow the animal(s) back into the corporate limits per subsection 6.06.050H of this chapter.
   F.   No person shall bring or lead any dog in any park or public playground area unless it is held by a leash not more than six feet (6') long.
   G.   It shall be unlawful for any owner of any dog, cat, miniature pig or other animal to go upon any public street, alley or sidewalk or other public place unless such animal is securely on a leash not more than six feet (6') long.
Any owner who violates any provision of this section shall be subject to a minimum fine of three hundred dollars ($300.00) and a maximum fine of seven hundred fifty dollars ($750.00) as so stated above. In addition, the village of Beach Park can disallow the animal(s) from returning to the village per subsection 6.06.050H of this chapter. (Ord. 2007-O-84 § 2)
