6.06.020: DEFINITIONS:
Whenever used in this chapter, unless a contrary intention is clearly evident, the following terms are used, as herein defined:
ADMINISTRATOR: A veterinarian licensed by the state of Illinois, assigned to the animal/rabies control program by the Lake County health department.
AGENT FOR THE VILLAGE OF BEACH PARK: Any person so authorized by Beach Park to enforce this chapter.
ANIMAL: Any animal, other than man, which may be affected by rabies.
BOARD OF HEALTH: The Lake County board of health/Lake County animal control or its authorized representative.
CAT: Includes all members of the feline family.
CONTROL: Any owned animal that is either secured by a leash or lead not more than six feet (6') in length, or within a fenced premises of its owner, or confined within a crate or cage, or confined within a vehicle.
DANGEROUS DOMESTIC ANIMAL: Any animal either unmuzzled, unleashed, attended or unattended by its owner or keeper, in a terrorizing, menacing or threatening unprovoked manner approaches any person or other animal in an apparent attitude of attack upon streets, sidewalks or any public ground or place or on private property other than the owner on one reported occasion.
DOG: Includes all members of the canine family.
DOMESTIC ANIMAL: To train or adapt an animal to live in a human environment and to be of use to human beings.
FOUND TO BE A DANGEROUS OR VICIOUS ANIMAL: The village or authorized agent, law enforcement agency, or animal control warden has conducted an investigation and made a finding in writing that the animal is a dangerous animal or vicious as defined in this section and based on the finding, the village of Beach Park authorized agent, law enforcement agency or an animal control warden has declared in writing that the animal is a dangerous or "vicious animal" as defined in this section and has entered an order based on the finding.
FURBEARING MAMMALS AND WILD ANIMALS: Includes, but is not limited to, the following specific species: arctic fox, badger, bat, beaver, bobcat, coyote, ferret, gray fox, hedgehog, mink, muskrat, opossum, prairie dog, rabbit, raccoon, red fox, river otter, skunks, weasel, woodchuck, wolf or any animal of this type and any wildlife cross or the offspring of a mating between a wolf or coyote and a dog.
GUARD DOG: A dog used in a commercial business for the purpose of protection and protection security.
HAS BEEN BITTEN: Has been seized with the teeth or jaws, so that the person or animal seized has been nipped or gripped, or has been wounded or pierced and includes contact of saliva with any break or abrasion of skin, or mucous membrane.
HEALTH DEPARTMENT: The Lake County health department or its authorized representative.
HOME CONFINEMENT: The animal must be kept within the house where the owner, caretaker, harborer is residing. If outside, the animal must remain on the property in a fenced in area of its owner and kept on a six foot (6') leash or monitored with a secure enclosure.
IMPOUNDED: Taken into the custody of the public pound, in the county where the animal is found.
LEASH: A cord, chain, rope, strap or other physical restraint having tensile strength of not less than three hundred (300) pounds.
LIVESTOCK: Includes any bison, burro, cattle, donkey, emu, fowl, geese, goats, horse, llama, mule, ostrich, pony, sheep or swine or any animal of this type.
MULTIPLE ANIMAL OWNER: Any owner, keeper or harborer who has five (5) or more dogs or cats that must be licensed.
MUZZLED: A device to prevent biting any person or animal, it must be constructed of a strong material or metal.
OWNER: Any person having a right of property in a dog, cat or other animal or who keeps or harbors a dog, cat or other animal or who has it in his care or by providing medical treatment, or acts as its custodian or who knowingly permits it to remain on or about their premises for a period of seven (7) days or more.
PARCEL: Any legally described piece of land.
PATIENT: Any person who has been attacked/bitten by an animal.
PERSON: Any person, firm, corporation, partnership, society, association or other legal entity, any public or private institution, municipal corporation or political subdivision, or any other business unit.
PUBLIC NUISANCE OR PRIVATE NUISANCE: Any animal or animals which molests or attacks a person or a passing vehicle, attacks other animals, is found to be a dangerous animal, is found to be running at large, damages private or public property or barks, whines or howls in an excessive, continuous or untimely manner.
RESIDENTIAL: Use of land that provides space for the permanent occupancy of either individuals or families within dwellings.
RUNNING AT LARGE: Those animals which are not on their owner's property or under control of their "owner" as defined in this section.
SEIZE: The health department, village, or agent for the village or any officer of the law is authorized to enter upon public or private property for the purpose of impounding any dog, cat or other animal which has been found to be in violation of this chapter.
VICIOUS ANIMAL: Any animal that has, without provocation, attacked a human being or other domestic animal or a vicious dog that by its behavior or physical condition constitutes an immediate and serious physical or health threat to human beings or animals or any vicious dog which has previously attacked or bitten any human being or other animal on one reported occasion.
