5.24.080: REVOCATION OF PERMIT; APPEALS:
   A.   Notwithstanding any other provision in this code, if, in the judgment of the village administrator, or his designees, an emergency situation has been created such that the continued use of public or private property by a permittee will immediately threaten life, health or property, the village administrator, or his designees, upon the issuance of a written order stating the reason for such conclusion and without notice or hearing may immediately revoke the permit and require the use of public or private property to immediately cease. No person shall continue to use public or private property contrary to such order.
   B.   The decision of the village administrator, or his designees, to revoke a permit required by this chapter shall be appealable by the sponsor to the president and board of trustees. Such appeal shall be initiated by a written notice to the president and board of trustees before the close of the next regular village business day after the date of service of such revocation, or such appeal shall be deemed waived. The sponsor shall be given an opportunity to be heard by the president and board of trustees upon such revocation within three (3) business days after receipt of any such notice of appeal. The president and board of trustees may sustain or reverse the decision of the village administrator, or his designees, based on the criteria set forth in subsection 5.24.040C of this chapter. Such decision shall be made by the president and board of trustees before the close of the next village regular business day following the conclusion of any such hearing. The sponsor shall receive written notice of the president and board of trustees decision, which decision shall be a final decision for the purpose of administrative review. (Ord. 2006-O-08 § 1)
