5.16.180: LOCATION RESTRICTIONS:
   A.   No license shall be issued for the sale at retail of any alcoholic liquor within one hundred feet (100') of any church, school, hospital, home for aged or indigent persons or for veterans, or their wives or children; provided, that this prohibition shall not apply to hotels offering restaurant service, or to restaurants, or food shops where sale of alcoholic liquors is not the principal business carried on, if such place of business meets the following criteria: 1) the immediately prior owner or operator of the premises operated the premises as a restaurant and held a valid retail license for the sale of alcoholic liquor for at least part of the twenty four (24) months before the change of ownership and 2) the restaurant is located seventy five (75) or more feet from a school.
   B.   Licenses issued hereunder apply only to the premises described in the application and in the license issued thereon, and only one location shall be so described in each license. After a license has been granted for particular premises, the local liquor commissioner, upon proper showing, may endorse upon said license permission to abandon the premises therein described and remove therefrom to other premises approved by the commissioner, but in order to obtain such approval, the licensee shall file with the commissioner a request in writing and a statement under oath which shall show that the premises to which removal is to be made comply in all respects with the requirements of this chapter.
   C.   There shall be a three hundred dollar ($300.00) fee for transfer of said license. (Ord. 2006-O-14 § 1)
