5.16.020: DEFINITION OF TERMS:
   A.   All words and phrases used in this chapter, and defined in the Illinois liquor control act 1 , enacted January 31, 1934, and in effect July 1, 1934, shall have the same meaning herein as they have in the act, as amended.
   B.   The words "the village" as used in this chapter shall be taken to mean and include all territory within the geographical limits of the village of Beach Park, Lake County, state of Illinois.
   C.   Terms used in this chapter have the following meanings:
   ABANDONMENT: Six (6) months of discontinued alcohol sales.
   ALCOHOL: Ethyl alcohol, hydrated oxide of ethyl, or spirits of wine, whiskey, rum, brandy, gin, or any other distilled spirits including dilutions and mixtures thereof from whatever source or by whatever process produced.
   ALCOHOLIC BEVERAGE: Alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol, spirits, wine, beer, and which contains one-half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances.
   ALCOHOLIC LIQUOR: Any spirits, wine, beer, ale or other liquid containing more than one-half of one percent (0.5%) of alcohol by volume which is fit for beverage purposes.
   BANQUET HALL: Any public place kept, used, maintained, advertised and held out to the public where meals and/or beverages are served to a group or groups of people not less than twenty five (25) persons, without sleeping accommodations, such place being provided with adequate sanitary kitchen and dining room equipment and capacity.
   BEER: A beverage obtained by alcoholic fermentation of an infusion or concoction of barley or other grain, malt and hops in water, and includes, among other things, beer, ale, stout, lager beer, porter and the like.
   BOWLING LANE BUSINESS: A business in which the principal income therefrom is derived from the operation of bowling lanes open to the public and which is advertised to the public as a bowling lane.
   BREWPUB: A person who manufactures beer only at a designated premises to make sales to importing distributors, distributors and to nonlicensees for use and consumption only, who stores beer at the designated premises and who is allowed to sell it retail.
   CATERER RETAILER: A person who serves alcoholic liquor for consumption, either on site or off site, whether the location is licensed or unlicensed, as an incidental part of food service. Prepared meals and alcoholic liquors are sold at a package price agreed upon under contract.
   CLUB: A corporation organized under the laws of this state, not for pecuniary profit, solely for the promotion of some common object other than the sale or consumption of alcoholic liquors, kept, used and maintained by its members through the payment of annual dues, and owning, hiring or leasing a building or space in a building, of such extent and character as may be suitable and adequate for the reasonable and comfortable use and accommodation of its members and their guests and provided with suitable and adequate kitchen and dining room space and equipment and maintaining a sufficient number of servants and employees for cooking, preparing and serving food and meals for its members and their guests; provided, that such club files with the local liquor control commissioner at the time of its application for a license under this chapter two (2) copies of a list of names and residences of its members, and similarly files within ten (10) days of the election of any additional member his name and address; and, provided further, that its affairs and management are conducted by a board of directors, executive committee, or similar body chosen by the members at their annual meeting and that no member or any officer, agent, or employee of the club is paid, or directly or indirectly receives, in the form of salary or other compensation any profits from the distribution or sale of alcoholic liquor to the club or the members of the club or its guests introduced by members beyond the amount of such salary as may be fixed and voted at any annual meeting by the members or by its board of directors or other governing body out of the general revenue of the club.
   COMMISSIONER: The mayor of the village, or his or her designee.
   CONVEYANCE: Any vehicle, trailer, watercraft or container operated for the transportation of persons or property.
   CRIMINAL CODE: The Illinois criminal code of 1961, 730 Illinois Compiled Statutes 5/11-1 et seq., as amended.
   EVENT OR GATHERING: Any group of three (3) or more persons who have assembled or gathered together for a social occasion or other activity.
   GOLF CLUB: Any place kept, used, maintained, either privately or advertised and held out to the public as a place where golf is played on an established and maintained golf course and containing a clubroom or clubhouse containing locker rooms, and a restaurant either for the public or for its members.
   HOST: To aid, conduct, allow, entertain, organize, supervise, control, or permit an event or gathering.
   HOTEL: Every building or other structure kept, used, maintained, advertised and held out to the public to be a place where food is actually served and consumed and sleeping accommodations are offered for adequate pay to travelers and guests, whether transient, permanent or residential, in which twenty five (25) or more rooms are used for the sleeping accommodations of such guests and having one or more public dining rooms where meals are served to such guests, such sleeping accommodations and dining rooms being conducted in the same building or buildings in connection therewith and such building, buildings, structure or structures being provided with adequate and sanitary kitchen and dining room equipment and capacity 2 .
   ILLICIT DRUGS: Any drug, substance, or compound prohibited by law, including drugs prescribed by a physician that are in the possession of or used by someone other than the person to whom the drug was prescribed.
   LIQUOR CONTROL ACT: The liquor control act of 1934, 235 Illinois Compiled Statutes 5/11-1 et seq., as amended.
   ORIGINAL PACKAGE: Any bottle, flask, jug, can, cask, barrel, keg, hogshead or other receptacle or container whatsoever, used, corked or capped, sealed and labeled by the manufacturer of alcoholic liquor, to contain and to convey any alcoholic liquor 3 .
   PARENT: Any person having legal custody of a juvenile:
      1.   As a natural, adoptive parent, or step parent;
      2.   As a legal guardian; or
      3.   As a person to whom legal custody has been given by order of the court.
   PERSON: Any individual, firm, association, partnership, corporation, trust, or any other legal entity.
   PUBLIC PLACE: Any place to which the public or a substantial group of the public has access and includes, but is not limited to, streets, highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities, parks, businesses, or parking lots.
   REASONABLE STEPS: Controlling access to alcoholic beverages at the event or gathering; controlling the quantity of alcoholic beverages present at the event or gathering; verifying the age of persons attending the event or gathering by inspecting drivers' licenses or other government issued identification cards to ensure that minors do not consume alcoholic beverages while at the event or gathering; and supervising the activities of minors at the event or gathering, calling for police assistance in the event people under twenty one (21) are in possession of alcohol at the event or gathering or advising law enforcement in advance of departing one's residence that the owner will be away and no underage person is authorized to be present and consume alcohol at the owner's residence.
   RELIGIOUS CEREMONY: The possession, consumption, and dispensation of alcohol or an alcoholic beverage for the purpose of conducting any bona fide rite or religious ceremony.
   RESIDENCE OR PREMISES: Any home, yard, farm, field, land, apartment, condominium, hotel or motel room, or other dwelling unit, or a hall or meeting room, park, or any other place of assembly, public or private, whether occupied on a temporary or permanent basis, whether occupied as a dwelling or specifically for a party or other social function, and whether owned, leased, rented, or used with or without permission or compensation.
   RESTAURANT: Any place kept, used, maintained, advertised and held out to the public as a place where meals are served, and where meals are actually and regularly served, without sleeping accommodations, such space being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food for its guests.
   RETAIL SALE: Any transfer, exchange or barter in any manner or by any means whatsoever, for a consideration, made by any person, whether principal, proprietor, agent, servant or employee; and shall include to solicit or receive an order for, or to deliver, or to accept payment for.
   RETAILER: A person who sells, or offers for sale, alcoholic liquor for use or consumption and not for resale in any form 4 .
   SELL AT RETAIL AND SALE AT RETAIL: Sales for use or consumption and not for resale in any form 5 .
   SPECIAL USE LICENSE: A license for use by a retailer to allow the transfer of alcoholic beverages from an existing licensed retail premises to a designated site for a special event.
   SPIRITS: Any beverage which contains alcohol obtained by distillation, mixed with water or other substance in solution, and includes brandy, rum, whiskey, gin, or other spirituous liquors, and such liquors when rectified, blended or otherwise mixed with alcohol or other substances 6 .
   TAVERN: An establishment where liquors are sold to be consumed on the premises but not including restaurants where the principal business is the serving of food.
   TO SELL: Includes to keep or expose for sale and to keep with intent to sell 7 .
   UNDERAGE PERSON: Any individual less than twenty one (21) years of age.
   WINE: Any alcoholic beverage obtained by the fermentation of the natural contents of fruits or vegetables, containing sugar, including such beverages, when fortified by the addition of alcohol or "spirits", as defined above 8 .
