AN ORDINANCE AMENDING CHAPTER 5.16 OF TITLE 5 OF THE BEACH PARK, ILLINOIS, VILLAGE CODE BY MODIFYING THE NUMBER OF LIQUOR LICENSES
 
   WHEREAS, the Village Code specifies the number of each liquor licenses available for issuance by the Liquor Commissioner; and
 
WHEREAS, the Mayor and Board of Trustees have determined that it would be appropriate to change the number of Beach Park Liquor License obtainable; and
 
   WHEREAS, it is determined by the Corporate Authority that it is in the best interests of the citizens of the Village of Beach Park to review and modify availability of liquor licenses from time to time.
 
   NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Beach Park, Lake County, Illinois, as follows:
 
SECTION 1:      Paragraph “A” of Section 5.16.090 of Title 5 of the Beach Park Village Code be and is hereby amended to provide as follows, where strike out (delete) indicates deletion of text and double underline (insert) indicates insertion of text:
 
5.16.090: NUMBER OF LICENSES: 
A. Not more than the following licenses for the following described classes shall be issued and outstanding at any one-time, which limitation shall be as follows:

SECTION 2:      Nothing in this Ordinance shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action arising, acquired or existing under any act or ordinance or portion thereof hereby repealed or amended by this ordinance; nor shall any just or legal right, claim, penalty or remedy of any character of the corporate authority existing on the effective date hereof be lost, impaired or affected by this Ordinance.
 
SECTION 3:       If any provision, clause, sentence, paragraph, section, or part of this ordinance or application thereof to any person, firm, corporation, public agency or circumstance, shall, for any reason, be adjudged by a court of competent jurisdiction to be unconstitutional or invalid, said judgment shall not affect, impair or invalidate the remainder of this ordinance and the application of such provision to other persons, firms, corporation, or circumstances, but shall be confined in its operation to the provision, clause, sentence, paragraph, section, or part thereof directly involved in the controversy in which such judgment shall have been rendered and to the person, firm, corporation, or circumstances involved. It is hereby declared to be the legislative intent of the Corporate Authorities that this ordinance would have been adopted had such unconstitutional or invalid provision, clause, sentence, paragraph, section, or part thereof not been included.
 
SECTION 4:      This ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as required by law.

   I do further certify that at a regular meeting of the President and Board of Trustees of the Village of Beach Park, held on the 11th day of April 2024, the foregoing Ordinance entitled AN ORDINANCE AMENDING CHAPTER 5.16 OF TITLE 5 OF THE BEACH PARK, ILLINOIS, VILLAGE CODE BY MODIFYING THE NUMBER OF LICENSES, was duly passed by the President and Board of Trustees of the Village of Beach Park.
 
   The pamphlet form of Ordinance No. 2024-O-9 including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was available in the Village Hall, commencing on the 11th day of April 2024, and will continue for at least 10 days thereafter. Copies of the Ordinance are also available for public inspection upon request in the office of the Village Clerk.
 
   I do further certify that the original, of which the attached is a true and correct copy, is entrusted to me as the Clerk of said Village for safekeeping, and that I am the lawful custodian and keeper of the same.
