A. Definition. For the purposes of this section demolition shall mean any act or process within the control of the owner of any building or structure that:
1. Results in a change to the footprint of the building or structure;
2. Removes or destroys the structure or building;
3. Removes, destroys, or otherwise involves construction activity impacting 250 square feet or more of the interior of the structure or building; or
4. Removes or destroys 50 percent or more of the gross floor area, as defined in the Municipal Code, of the structure or building.
B. Demolition Permit Required. A demolition permit from the building official shall be required for all demolitions. The application for said demolition permit shall be on the form provided by the Village and include all information as deemed necessary to ensure the safe demolition of the structure, protection of excavations, and proper restoration of the property. The following shall be required unless waived by the building official:
1. A letter from the utility companies stating the meters and service have been removed from the property (ComEd, North Shore Gas, etc.).
2. A letter from the Village of Beach Park Water Department (or other supplier, if applicable) stating the meter has been removed.
3. Documentation from the Lake County Health Department stating that all requirements for well and/or septic have been satisfied (if applicable).
4. All commercial properties require a Phase 1 Environmental Study stating all asbestos and other contaminants have been removed and showing no asbestos or toxic chemicals are present. If such contaminants are found, a document from an abatement contractor shall be submitted to the Village of Beach Park verifying all contaminants have been removed.
5. A Plat of Survey showing the location and dimension of the area where at the street, alley, or parkway an opening will be made for disconnection of water and sewer lines.
6. Prior to issuance of permit, contractor shall supply the Village of Beach Park a Certificate of Insurance in the amount of $1 million naming the Village, its elective and appointed board, commissioners, officers, agents, and employees as additional insured.
7. All permit applications completed and submitted, including the Plat of Survey with dimensions to the Community Development Department.
C. Demolition Requirements.
1. Sanitary sewer service shall be removed up to the main and the well shall be capped.
2. Water services shall be removed at the main and a stainless-steel repair sleeve shall be installed.
3. All work shall be done in a neat, workmanlike manner without damaging main lines.
4. If a significant amount of water enters the trench during pipe removal, it shall be removed before operations may continue. No trench water shall be allowed entry into system.
5. The Water and Sewer Department must be contacted at least 24 hours prior to backfilling.
6. No work is to be started until a permit is issued.
7. Site shall be graded and erosion cover planted.
8. Dust control is required.
9. Contractor responsible for maintaining public roads free of dirt, mud, and debris.
10. Restoration of the site and adjacent area to Village standards is required. This includes any public property, streets, sidewalks, rights of way, parkways, utilities, and any private property, utilities, and structures impacted or damaged.
11. Erosion protection and storm water runoff protection are required, subject to the Lake County Watershed Development Ordinance.
D. Demolition Permit Fees. The fees for demolition permits required pursuant to this section shall be those established and listed in Title 3 Revenue of the Municipal Code.
E. Successive Demolitions are Cumulative. All demolition activities taking place on a single site within any consecutive 36-month period shall be deemed cumulative for the purposes of determining the required permits, plans, and fees under this section, unless the building official determines in writing that such demolition activities are the result of unforeseeable circumstances.
F. Deposit Required. A cash deposit or surety bond shall be submitted along with the demolition permit application. No deposit or surety bond shall be returned prior to the satisfactory completion of the demolition and restoration, as determined by the building official.
G. Emergency permit. A demolition permit may be issued by the building official upon the building official's determination that demolition of the building or structure is necessary to eliminate or prevent a threat to public safety. (Ord. 2023-O-8)
