3-3-10: PROHIBITED CONDUCT:
   A.   Unlawful To Permit: It shall be unlawful for any person licensed to sell malt liquor, intoxicating liquor, or wine, on- sale in the city to permit on the licensed premises:
      1.   Nudity: Any person to display, either directly, or indirectly, in person, by pictures, film, or otherwise, "nudity" as term is defined by Minnesota statutes section 617.292, subdivision 3.
      2.   Sexual Acts: Any person to perform acts of or acts which simulate:
         a.   "Sexual conduct" as this term is defined by Minnesota statutes section 617.292, subdivision 4;
         b.   "Sexual excitement" as this term is defined by Minnesota statutes section 617.292, subdivision 5;
         c.   "Sadomasochistic abuse" as this term as defined by Minnesota statutes section 617.292, subdivision 6.
   B.   Unlawful To Remain On Premises: It shall be unlawful for any on-sale intoxicating liquor, malt liquor, or wine licensee to permit any person to remain in or upon the licensed premises who exposes to public view or performs or simulates any of the conduct or activities enumerated and prohibited in subsection A of this section.
   C.   Unlawful To Perform: It shall be unlawful for any person within the premises licensed for the sale of malt liquor, intoxicating liquor, or wine on-sale to display publicly or perform any acts which are prohibited in subsection A of this section.
   D.   Penalty: Any person who shall violate any of the provisions of this section shall be guilty of a misdemeanor, and upon conviction, shall be subject to penalty as provided in section 1-4-1 of this code. (Ord. 10.8, 8-3-1982; amd. 2002 Code)
