8-2-13: CIVIL DAMAGES, FALSE INFORMATION, TAMPERING AND PENALTIES:
   A.   Civil Damages: Any user violating any of the provisions of this chapter or who has a discharge which causes a deposit, obstruction, damage or other impairment to the city's wastewater disposal system shall be liable to the city for any expense, loss, or damage caused by the violation or discharge. The public works director may add to the user's charges and fees the cost assessed for any cleaning, repair, or replacement work caused by the violation or discharge. Refusal to pay the assessed costs is a violation of this chapter.
   B.   Falsifying And Tampering: No person shall knowingly make a false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this chapter or tamper or render inaccurate any monitoring device required under this chapter.
   C.   Penalties: Any person violating any of the provisions of this chapter is guilty of a misdemeanor.
   D.   Fines: The BPUC may also establish fines for any person violating the local limits established in section 8-2-5 of this chapter. The BPUC shall annually review and establish the amount of the fines. Fines shall be considered punitive to encourage compliance and will not be based on actual damages. Fines shall be assessed for a violation upon the recommendation of the public works director and confirmation by the BPUC. (2002 Code)
