6-1-5: MOTORIZED VEHICLES ON RUSH LAKE:
   A.   Purpose, Intent And Application: As authorized by Minnesota statutes 86B.201, 86B.205, and 459.20, and Minnesota rules 6110.3000–6110.3800 as now in effect and as hereafter amended, this section is enacted for the purpose and with the intent to control and regulate the use of the waters of Rush Lake in the city of Baxter, county of Crow Wing, state of Minnesota, said body of water being located entirely within the municipal boundaries of Baxter, to promote its fullest use and enjoyment by the public in general and the citizens of Baxter in particular; to ensure safety for persons and property in connection with the use of said waters; to harmonize and integrate the varying uses of said waters; and to promote the general health, safety and welfare of the citizens of Baxter, Minnesota.
   B.   Definitions: Terms used in this section relating to boating are defined in Minnesota statutes section 86B.005.
   C.   Surface Zoning: No motorized boats or other motorized watercraft shall be permitted upon the open waters of Rush Lake. Motorized vehicles shall be permitted, according to all other rules and regulations, upon Rush Lake when the lake is covered with ice.
   D.   Exemptions: All authorized resource management, emergency and enforcement personnel, while acting in the performance of their assigned duties, are exempt from the foregoing restrictions.
   E.   Enforcement: The primary responsibility for enforcement of this section shall rest with the city of Baxter police department and the Crow Wing County sheriff's office. This shall not preclude, however, the enforcement by other licensed peace officers.
   F.   Notification: The city of Baxter shall post notice of this section at any public access to Rush Lake and at other reasonable locations.
   G.   Penalties: Any person who shall violate any of the provisions of this section shall be guilty of a misdemeanor. (Ord. 2004-12, 9-8-2004)
