3-18-4: INELIGIBILITY FOR LICENSE:
   A.   Persons Ineligible: No license under this chapter will be issued to an applicant who is a natural person, a partnership if such applicant has any general partner or managing partner, a corporation or other organization if such applicant has any manager, proprietor or agent in charge of the business to be licensed, if the applicant:
      1.   Is a person not a citizen of the United States or a resident alien;
      2.   Is a person under eighteen (18) years of age;
      3.   Has been convicted of any crime directly related to the occupation licensed as prescribed by Minnesota statutes, section 364.03, subdivision 2, and has not shown competent evidence of sufficient rehabilitation and present fitness to perform the duties of a licensee under this chapter as prescribed by Minnesota statutes 364.03, subdivision 3;
      4.   Is a person who, within five (5) years of the license application date, had a pawnbroker or secondhand goods dealer license revoked;
      5.   Is a person who the city council determines not to be of sufficient good moral character and repute; or
      6.   When the city council determines, after investigation and public hearing, that issuance or renewal of the license would adversely affect the public health, safety, or welfare.
   B.   Ineligible Locations: A license will not be issued or renewed under this chapter for any place or for any business:
      1.   If taxes, assessments or other financial claims of the city or the state on the licensee's business premises are delinquent and unpaid;
      2.   If the premises for a pawnbroker is located within three hundred feet (300') of a school or church; or
      3.   Where operation of a licensed premises would violate zoning ordinances. (Ord. 2021-004, 4-20-2021)
