§ 31.16 SPECIAL AND EMERGENCY MEETINGS.
   (A)   (1)   A special meeting may be called by the Mayor or by any other two members of the City Council, upon request to the Clerk/Treasurer. The Clerk/Treasurer shall mail or deliver or otherwise give notice to each City Council member of the date, time, place, and purpose of the special meeting at least three days before the date of the meeting.
      (2)   The Clerk/Treasurer shall post written notice of the date, time, place, and purpose of the special meeting on the principal bulletin board of the City Council. If there is no principal bulletin board of the City Council, the Clerk/Treasurer shall post the notice on the door of the Council Chamber. The notice shall also be mailed or otherwise delivered to each person who has filed a written request for notice of special meetings with the Clerk/Treasurer. The notice shall be posted and mailed or delivered at least three days before the date of the meeting. As an alternative to mailing or otherwise delivering notice to persons who have filed a request for notice, the Clerk/Treasurer may publish the notice once, at least three days before the meeting, in the official newspaper of the city. If a person filing a request for notice has limited the request for notice to particular subjects, the Clerk/Treasurer may send notice to that person only of those special meetings involving those subjects.
      (3)   Any request for notice of special meetings shall expire on December 31 of the year in which the request was filed, unless the person refiles a request for notice. The Clerk/Treasurer shall send notice of the refiling requirement to each person not more than 60 days and not less than ten days before the expiration date of the request for notice.
      (4)   If the Clerk/Treasurer fails to give notice of the refiling requirement or determines not to do so, the request for notice shall remain in effect the following calendar year.
   (B)   An emergency meeting may be called by the Mayor or by any other two members of the City Council upon request to the Clerk/Treasurer, whenever, in their judgment, circumstances require immediate consideration of any matter by the City Council. Notice of the date, time, place, and purpose of the meeting shall be given by the Clerk/Treasurer to each City Council member, by telephone or by any other method. The Clerk/Treasurer shall make a good faith effort to give notice of the meeting by telephone or by any other method best calculated to give actual notice to each news medium that has filed a written request for notice if the request includes the news medium’s telephone number. Even if not required by law, the Clerk/Treasurer shall give similar notice to any person who has filed a written request for notice if the request includes the person’s telephone number, shall post the notice the same as for special meetings as soon as may be done and shall cause the notice to be published if such may be done.
   (C)   If matters not directly related to the purpose or purposes for which an emergency or a special meeting was called are discussed or acted upon at the meeting, the Clerk/Treasurer shall include in the minutes a specific description of each other matter discussed or acted upon. If a person receives actual notice of a meeting at least 24 hours before the meeting, all notice requirements for the meeting shall be considered satisfied with respect to that person, regardless of the method of receipt of notice. Any further requirements of law shall also be complied with in calling and holding any meeting.
