(A) Any person violating any provision of this title for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) (1) It is a misdemeanor for any person to do any act forbidden or fail to perform any act required by this title.
(2) Any person who violates his or her written promise to appear given to a Town Marshal upon arrest for any traffic violation, per § 70.07, is guilty of a misdemeanor regardless of the disposition of the charge of which he or she was originally arrested.
(3) Unless another penalty is expressly provided by law, every person convicted of a violation of any provision of this title shall be punished by a fine of not more than $500, or another amount as set by the Town Council from time to time, or by imprisonment for not more than 180 days or by both such fine and imprisonment.
(C) Any person who is issued his or her first citation for violation of § 70.01 shall be fined $50, or another amount as set by the Town Council from time to time. The fine for each subsequent offense shall be not less than $100 and not more than $2,500, or another amount as set by the Town Council from time to time. An officer of the Town Police Department shall issue a citation to an individual who violates § 70.01. Violators may be prosecuted through the County Court or any other court with jurisdiction over traffic infractions.
