§ 153.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   If any person, firm, or corporation shall violate any of the provisions of §§ 153.15 to 153.32, or shall do any act prohibited therein, or shall fail to perform any duty lawfully enjoined, within the time prescribed by the Building Commissioner, or shall fail, neglect, or refuse to obey any lawful order given by the Building Commissioner in connection with the provisions of §§ 153.15 to 153.32, for each violation, failure, or refusal, such person, firm, or corporation shall be fined in the sum of $50, or another amount as set by the Town Council from time to time. Each day of such unlawful activity as is prohibited by the first sentence of this division (B) shall constitute a separate offense.
   (C)   (1)   Any person violating the provisions of §§ 153.45 to 153.52 or I.C. 36-7-9-28 shall commit a class C infraction for each day such violation continues.
      (2)   Any person violating the provisions of §§ 153.45 to 153.52 or the provisions of the Indiana Code as adopted herein shall commit a separate violation for each day that such violation continues and shall be subject to a penalty of not more than $2,500, or another amount as set by the Town Council from time to time, for each violation. The implementation of this penalty shall be at the discretion of the town and shall be separate, independent, and in addition to any other provisions of §§ 153.45 to 153.52.
