A. Every agent and employee of a licensee and/or a business for which a license is issued under this chapter who sells, serves or delivers alcoholic liquor, or who supervises persons who sell, serve or deliver alcoholic liquor, shall be trained and maintain current certification by the beverage alcohol sellers and servers education and training (BASSET) program licensed and administered by the state of Illinois liquor control commission (ILCC) or similar program approved by the chief of police, except as specifically provided herein.
B. Service of alcohol for C, F and G licenses shall be governed as follows:
1. Class C licensees shall have at least one person who is on duty at all times that alcoholic liquor is allowed to be carried into the premises who has current Illinois BASSET or equivalent training certification;
2. Class F nonprofit licensees shall have at least one person who is present at all times that alcoholic liquor is served who has current Illinois BASSET or equivalent training certification, and no additional persons are required to have the training and certification, provided:
a. There have been no ordinance violations in connection with the issuance of a special event liquor license, or any other liquor license, in the prior five (5) years;
b. Uniformed Batavia police officers and/or other security approved by the city police department are present at all times that alcoholic liquor is being served. The number of police officers and/or security personnel shall be determined by the city police department;
c. At least one representative of the applicant organization with current BASSET training certification shall be present at all times where alcoholic liquor is being served;
d. The BASSET trained and certified representative of the applicant shall provide instruction to all persons who will be serving at the special event.
3. Class G licensees shall have all persons who are serving alcoholic liquor to have current BASSET or equivalent training and certification, except that persons who are pouring alcohol only, and not serving it, are not required to be trained and certified.
C. A "state certified BASSET or similar training program" means a program licensed by the state of Illinois liquor control commission (ILCC) as required by 235 Illinois Compiled Statutes 5/3-12 (11.1) and 6-27 and title 77 of Illinois administrative code, chapter XVI, section 3500, with instruction given by licensed providers having records on file proving current qualifications and certification of course completion.
D. Any new manager and any employee or agent who will serve alcoholic liquor for a licensee shall, within ninety (90) days from the date first employed with that licensee, complete a BASSET or similar training and shall, until completion of the BASSET program, work under the direct supervision of a person who has current BASSET training and certification.
E. A photocopy of all certificates of completion of BASSET training for all owners, managers, employees, or agents required by this chapter to have BASSET training shall be maintained, by the licensee in a manner that will allow inspection upon demand by city police department.
No person, including employees, volunteers and any person providing services for a licensee, who is serving or supervising the serving of alcoholic liquor shall consume or be allowed to consume alcoholic liquor while on duty or during any break after which that person will return to duty serving or supervising the serving of alcoholic liquor.
