(A) The Batavia Union Cemetery shall be under the control and management of a Board of Cemetery Trustees pursuant to R.C. § 759.31.
(B) Pursuant to R.C. § 759.33, there shall be no distinction or discrimination made by the Board of Cemetery Trustees in favor of the village against the township or in favor of the township against the village; but the affairs of the cemetery shall in all respects be managed as though it were owned and governed in the interest of the village or township alone.
