§ 152.999  PENALTY.
   The following penalties and forfeitures shall apply to the violations of these regulations.
   (A)   Whoever violates any rule or regulation adopted by Council that sets standards or requires improvements in a subdivision or who fails to comply with any related order is creating a public nuisance.  The village or any village resident may enjoin and abate the nuisance by action at suit.  Whoever violates these regulations shall forfeit and pay not less than $10 nor more than $1,000, which the plaintiff may recover with costs in a civil action brought in the court of common pleas.

   (B)   Whoever being the owner or agent of the owner of any land in the village, transfers any lot, parcel or tract of such land from or in accordance with a plat or plan of a subdivision before such plan has been approved by the Planning Commission and recorded in the office of the County Recorder, shall forfeit and pay the sum of not less than $10 nor more than $500 for each lot, parcel or tract of land sold. The description of such lot, parcel or tract by metes and bounds in the deed or transfer shall not serve to exempt the seller from the forfeiture provided in this section. Such sum may be recovered in a civil action, brought by the Village Solicitor or Planning Commission in the name of the village and for the use of the road repair fund thereof. The sale of lots, parcels or tracts from a plat of a subdivision on which any and all areas indicated as streets or open grounds are expressly indicated as for the exclusive use of the abutting or other owners in such subdivision and not as public streets, ways or grounds shall not serve to exempt the seller from the requirements of these regulations or from the forfeiture herein provided.

   (C)   Every plat or subdivision of land within the incorporated area of the village and every act of platting or subdividing thereof shall be subject to all rules and requirements of these regulations and of R.C. Chapter 711, and any violation of such rules or requirements shall be subject to the penalties and forfeitures as set forth in this section and as set forth in the Ohio Revised Code.
