§ 152.004  AUTHORITY.
   (A)   R.C. § 711.09 enables a Village Council and/or Planning Commission to adopt general rules and regulations governing plats and subdivisions of land falling within its jurisdiction, and requires that all plats and all subdivisions within such jurisdiction shall first be approved by the Planning Commission before they may be recorded.
   (B)   Before adoption of such rules and regulations, the Planning Commission may hold a public hearing and if such rules and regulations require the actual construction of improvements or facilities, or assurance of such construction as a condition precedent to approval, these requirements shall first be adopted by Council after a public hearing. Rules and regulations adopted pursuant to R.C. § 711.09 governing the approval of plats and subdivisions are in lieu of any other approvals provided in any other sections of the Ohio Revised Code, so far as the territory within the approving jurisdiction of the Village Planning Commission is concerned as provided in R.C. § 711.09.
