§ 35.09 ELECTRONIC SIGNATURE ON INDOT CONTRACTS.
   (A)   For purposes of entering into contracts with the Indiana Department of Transportation, (“INDOT”), it shall be sufficient, in order to bind the county to the terms and conditions of any contract with INDOT, if the contract is signed by one Commissioner in an electronic format, or such other format as INDOT designates, requires or allows and further, that said signature need not be attested to by the County Auditor, provided that the following conditions are met:
      (1)   The contract shall have been considered in a scheduled public meeting of the County Commissioners.
      (2)   A quorum of the Commissioners shall have been in attendance at the meeting in person or in such other manner as authorized by law or executive order.
      (3)   The contract shall have been approved by at least a majority vote of the Commissioners.
   (B)   The contract shall be signed by the Chairperson of the Commissioners if the Chairperson is in attendance at the meeting at which the contract was approved; in the absence of the Chairperson, the contract may be signed by any Commissioner who is in attendance at the meeting at which the contract was approved.
