§ 91.39 AUTHORIZATION FROM DIRECTOR OF DIVISION OF ENVIRONMENTAL HEALTH.
   Any type of outdoor burning or fire which is otherwise prohibited under this subchapter may take place upon the prior written approval of the Director of the Division of Environmental Health of the County Health Department or his or her designated agent. Any person seeking the approval shall submit a written request in advance stating the nature of the burning or fire for which approval is sought, the location and date on which it will occur, the safety precautions which will be observed and the reasons why the request should be granted. The Director of the Division of Environmental Health shall consider the request and shall promptly approve or disapprove the request on the basis of demonstrated need and a determination of whether the approval of the request would endanger the public health safety or welfare or violate any other federal, state or local law or ordinance.
