§ 91.21 MODIFICATIONS TO THE STATE FIRE MARSHAL.
   (A)   No substances, material or devices not approved by the Code shall be stored, handled or used in any construction alterations or additions unless the owner thereof or his or her duly authorized representative submits application for approval thereof to the State Fire Marshal in accordance with state general administrative rules (675 I.A.C. 21.1) and all rules amendatory thereof and supplemental thereto.
   (B)   If the owner thereof or his or her duly authorized representative is of the opinion that there are practical difficulties in complying with the strict requirements of the Code, but that the spirit of the Code shall be complied with, public safety secured and substantial justice done, he or she may submit an application for variance therefrom to the State Fire Marshal.
