9-1-3: BUILDINGS IN NONCOMPLIANCE A NUISANCE; ABATEMENT:
Any wooden building or part of any wooden building which may be erected, enlarged, removed or repaired contrary to this chapter shall be deemed a nuisance, and upon information of such violation, the mayor shall give due and reasonable notice to the owner and builder thereof to abate, remedy or remove the same or such part thereof as may be deemed necessary. Upon the owner's failure to comply with said notice, the mayor shall, by an order in writing, require the chief of police and/or public works director to remove or tear down such building or such part thereof as may be necessary. The chief of police and/or public works director shall execute the order of the mayor and report the costs and expenses of such removal, under oath, to the city council for allowance, and such costs and expenses may be collected of the owner or builder of any such building liable therefor, by suit, in the name of the city before any court having jurisdiction.
