6-6-5: ACCEPTANCE OR APPROVAL OF IMPROVEMENTS:
   (A)   Acceptance of Public Improvements:
      1.   If any plat of subdivision contains public streets or easements or other improvements which are dedicated thereon as such, whether located within the corporate limits of the Village or in part outside thereof, or which contains existing streets located outside of said corporate limits, approval of the final plat by the Board of Trustees, approval of payouts under the terms of a guarantee of improvement, or subsequent annexation of the property to the Village shall not constitute an acceptance by the Village of such streets or easements, nor of the public improvements constructed or installed thereon or therein irrespective of any act by any officer, agent or employee of the Village with respect to such streets or improvements. The acceptance of all public improvements shall be made only by the adoption of a resolution by the Board of Trustees after there has been filed with the Village Clerk a certification by the Village Engineer stating that all public improvements required to be constructed or installed have been fully, or individually, completed, and that the construction or installation thereof has been approved by him.
      2.   After completion of all public improvements and prior to final acceptance of said improvements, the subdivider shall make or cause to be made "record" plans showing the actual location of all improvements. The plan shall be in black (ink) on tracing cloth or materials of equal permanence and durability and shall bear the seal and signature of the subdivider's engineer. The plans consisting of the original drawings and three (3) sets of blue line prints shall be submitted to the Village Engineer for permanent record. Presentation of the plans to the Village Engineer shall be a condition of final acceptance of the subdivision improvements.
      3.   No public street or roadway shall be accepted by the Village until forty percent (40%) of all lots in the subdivision in which said street is located shall have been fully improved with buildings as authorized thereon and certificates of occupancy have been issued. The surface course of a street, thoroughfare, alley or parking area shall be collectively considered as a single, or individual, improvement and such construction shall constitute release of the application portion of the performance surety. No public street or roadway shall be accepted by the Village during the months of November, December, January, February, March and April.
   (B)   Approval of Private Improvements:
      1.   For any plat of subdivision that contains a private street or easement, the approval of the private improvement shall be made only by the adoption of a resolution by the Board of Trustees after the filing, with the Village Clerk, of a certification by the Village Engineer stating that all private improvements required to be constructed or installed have been fully completed and that the construction or installation thereof has been approved by him.
      2.   After completion of all private improvements and prior to final approval of said improvements, the subdivider shall make or cause to be made "record" plans showing the actual location of all improvements.
