6-6-1: CONSTRUCTION CONTROL:
   (A)   Time of Construction Improvements: All public and private improvements required in this Title shall be installed after recording of the final plat. No work shall start prior to said recording.
   (B)   Time of Construction of Buildings: No building permits shall be issued for the construction of any building or structure unless a final plat has been approved and recorded and unless all required improvements have been provided as required by the final plat approval. However, permits may be issued if the following items are completed or installed and approved by the Village Engineer:
      1.   Grading operations;
      2.   Drainage improvements;
      3.   Bituminous concrete binder course or required seal coating;
      4.   Survey monuments; and
      5.   Street signs and traffic control signs.
   (C)   Use of Existing Streets: Only those streets designated by the Plan Commission during the approval of the final plat may be used for access to the subdivision by all equipment and trucks engaged in the construction of all improvements, utility services and buildings.
   (D)   Sequence of Construction: All underground public utilities, water mains, sanitary sewers or storm sewers installed in streets, alleys, service roads or highways shall be installed prior to the surfacing of such streets. Service connections to such underground utilities and sewers shall be extended to the property line of each lot so as to prevent disturbing the surface improvements in such public ways when service connections are later made. Where underground utilities are located in the parkway adjacent to the paved roadway, service connections to properties across such roads shall only be made by drilling under the pavement in such a way that the surfacing is not disturbed or weakened.
   (E)   Maintenance During Construction: The subdivider shall clean and maintain all streets, sewers and drains free from snow, mud, debris and trash or other extraneous material prior to acceptance or approval of the street by the Village and at such other times during construction as the Village Road Commissioner or Village Engineer or Enforcing Officer may deem necessary in accordance with Section 7-2-2 of the Village Code.
   (F)   Construction Noise: The subdivider shall take every precaution to assure that undue noise from construction operations is kept at a minimum. To assure that contractors are aware of this requirement, the following construction noise standards shall be made a part of all contracts entered into for construction of proposed improvements:
      1.   Any engine or engine-driven equipment used for hauling or construction activities shall be equipped with an adequate muffler in constant operation and properly maintained to prevent excessive or unusual noise. Furthermore, any machine or device or part thereof which is subject to Federal or State of Illinois Standards shall conform to those standards.
      2.   All construction operations shall be confined to weekdays and to available daylight hours during the time period between seven o'clock (7:00) A.M. and seven o'clock (7:00) P.M. No work shall take place on weekends or holidays. Exceptions to the above time restrictions shall be allowed for maintenance operations, for maintenance and operation of public safety and traffic control devices, or for construction of any emergency route.
      3.   The following terms which are used herein shall, for the purpose of this standard, be defined as follows:
         a.   Adequate Muffler: An "adequate muffler" is one which is equal to or quieter than the original muffler provided with the engine. If an engine was originally provided without a muffler, a muffler complying with the recommendations of the engine manufacturer shall be installed. Mufflers recommended by other than the engine manufacturer shall not be used.
         b.   In Constant Operation: The exhaust system shall not have a cutout, bypass or similar device as part of the operational system.
         c.   Properly Maintained: The various components of the engine exhaust system shall be maintained at all times. Such items as leaks, holes or improper operation shall be remedied by sealing, patching or replacing as necessary to insure proper operation of the system.
      4.   Requests to modify or deviate from these requirements shall be submitted in writing by the contractor and must be approved in writing by the Village Engineer.
   (G)   Liability During Construction: During the construction of the improvements and until the Village Board has accepted said improvements in accordance with Section 6-6-5 hereof, the Village shall not be responsible for any liability or property damage insurance to cover any liability incurred during the course of construction of the public street.
