§ 154.02 MINIMUMS STANDARDS FOR STREETS AND ROADS WITHIN A SUBDIVISION.
   Before considering acceptance of a street or road within a subdivision subject to the subdivision regulations of the Joint City and County Planning Commission the county onto the county road system, the following minimum requirements shall have been met.
   (A)   The minimum requirements pertaining to rights-of-way and construction of the subdivision regulations of the Joint City and County Planning Commission of the county must be complied with and so certified to the County Fiscal Court in writing, by the Chairperson of the Joint City and County Planning Commission of the county.
   (B)   The right-of-way must be completely cleared of stumps, logs, brush, and other matters which might deteriorate.
   (C)   All top soil shall be removed from the area of street construction. All fills shall be constructed of clay and packed so that the density of the surrounding sub-soil is achieved.
   (D)   Construction of the grade and drain shall have been completed and settled in a complete condition for two complete winters before construction of the street surface. (A complete winter shall be considered to be all of the months of December, January, and February in succession.)
   (E)   Street surfaces shall be constructed as follows:
      (1)   Minor streets. Minor streets are streets that are designed for or will be used primarily for access to abutting properties or which will carry limited volumes of traffic. Minor streets shall be constructed with a minimum of two inches of dense grade aggregate (measured after rolling), a minimum of two inches of binder, and one inch of rolled blacktop surface.
      (2)   Through streets. Through streets are streets, which due to their proximity to other streets or roads, are designed for or will be used to provide access from other streets or roads, and which will carry a large volume of traffic. Through streets shall be constructed with a minimum of four inches or dense grade aggregate (measured after rolling), a minimum of two inches of binder, and one inch of rolled blacktop surface.
   (F)   All drainage structures shall be of sufficient diameter to carry water reasonably expected to occur within the drainage area. Drainage structures from 15 inches to 24 inches in diameter shall be at least 16 guage, structures 24 inches to 36 inches shall be at least 14 guage, and structures 36 inches to 72 inches shall be at least 12 guage.
   (G)   The subdivider shall furnish a certification by a licensed engineer in a form prepared by the County Attorney and approved by the County Fiscal Court certifying that the above minimum requirements have been met.
   (H)   The Supervisor of the County Road Department shall be given prior notice of construction and an opportunity to inspect the work while it is in progress.
