§ 70.01 VEHICLES OF THE CONSTABLE.
   (A)   A constable in the county shall have the authority to equip the vehicle used by him or her with one or more flashing, rotating, or oscillating blue lights, visible under normal atmospheric conditions from a distance of 500 feet to the front of such vehicle, and a siren, capable of emitting a sound audible under normal conditions from a distance of not less than 500 feet, under the following terms and conditions.
      (1)   The constable shall comply with the provisions of KRS 304.39-110(2). On or before January 1 of each year, commencing with January 1, 1985, said constable shall exhibit to the Fiscal Court, or any designated officer, proof of said liability coverage for a period of not less than one year, with the provision that all constables duly elected and serving at the time of the passage of this section on second reading shall be required to exhibit proof of such coverage commencing with the date of the enactment of this section through and including January 1, 1985, before they shall be allowed to affix such emergency equipment to their respective vehicles.
      (2)   At no time while the constable’s vehicle is equipped with such emergency equipment shall the vehicle be painted or marked in any way similar or identical to the vehicles utilized by the County Sheriff’s Department.
      (3)   At no time while the constable’s vehicle is equipped with such emergency equipment shall the constable wear a uniform similar or identical in color or markings to the uniforms worn by the County Sheriff’s officers.
      (4)   The constable shall use such emergency equipment only in the district in which he or she was elected unless he or she is authorized by the County Sheriff or any one or more of the County Sheriff’s deputies to use such emergency equipment outside the district in which he or she was elected.
   (B)   Any constable who violates any provision of this section shall, at the request of the Fiscal Court, immediately remove the emergency equipment from his or her vehicle. Any such constable shall be entitled to an administrative hearing before the County Fiscal Court, conducted in accordance with the policy and procedures manual of the county.
   (C)   This section becomes effective immediately upon passage.
