§ 50.16 DEFINITIONS AND TENSE.
   (A)   Definitions. For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      BUSINESS. The collection, and/or hauling, of solid waste for ultimate disposal for persons other than one’s self, for any kind of return or remuneration (the rendering of assistance for cleaning up of property and/or the assemblage of waste as a handy man or yard worker is excluded from this definition).
      COMMERCIAL SOLID WASTE. Solid waste resulting from operation of any commercial, industrial, institutional, or agricultural establishment.
      PERMIT. An authorization to engage in the business of collecting and transporting solid waste under regulations established in this subchapter. May also be referred to as a LICENSE.
      PERSON. Any individual, partnership, corporation, association, joint stock company, trust, estate, political subdivision, or organization of any kind, or their legal representative, agent, or assigns.
      RESIDENTIAL SOLID WASTE. Solid waste resulting from the maintenance and operation of dwelling units.
      SHALL. The act referred to is always mandatory and not merely directory.
      SOLID WASTE. Any garbage, refuse, sludge, or other discarded material, including solid, liquid, semi-solid, or contained gaseous material resulting from industrial, commercial, mining (excluding coal mining waste, coal mining by-products, refuse, and overburden), and agricultural operations and from community activities, but does not include solid or dissolved material in domestic sewage, or solid or dissolved materials in irrigation return flows or industrial discharges .
      VEHICLE. Any truck, trailer, or other conveyance used in the collection and/or transport of solid waste.
   (B)   Tense; singular and plural. When not inconsistent with the context, words in the present tense include the future, words in the plural number include the singular number, and words in singular number include the plural number.
