§ 35.07 OUT OF COUNTY PRISONER’S FEES.
   (A)   A per diem fee of $12.50 per prisoner is hereby issued for all out of county prisoners incarcerated in the County Jail.
   (B)   The transferring county wishing to lodge a prisoner in the County Jail must first have the permission of the County Jailer and must be responsible for transporting the prisoner to and from the County Jail.
   (C)   The transferring county shall remain fully responsible for any special or unusual expenses incurred by the county in housing their prisoner, including but not limited to medical, dental, and hospital treatment as well as for the repair or replacement of any property damaged or destroyed by said prisoner.
   (D)   The transferring county shall immediately pick up and remove from the County Jail any prisoner upon notification by the County Jailer.
   (E)   The County Jailer shall have complete authority in the acceptance, supervision, and removal of any out of county prisoner, and the decision of the County Jailer shall be considered as final.
   (F)   All fees and expenses and claims owed to the county are payable upon presentation of a bill from the County Fiscal Court to the Fiscal Court of the county of the prisoner’s origin.
   (G)   Prisoners shall include juveniles.
   (H)   Because of the involvement of Hart, Metcalfe, and Monroe Counties, in the construction phase of the County Jail, in the event of overcrowded conditions, prisoners from the Counties of Hart, Metcalfe, and Monroe shall be given priority.
   (I)   The effective date of this section shall be July 1, 1982.
