9-2-1: DEFINITIONS OF WORDS AND PHRASES:
ADT: Average daily traffic.
ALLEY: A minor private or public thoroughfare, other than a dedicated half street, which is less than thirty feet (30') wide, upon which the rear of land or building lots generally abut, and which affords a secondary means of vehicular access to the land, buildings or lots. An alley cannot serve as primary access to a lot.
ANNEXATION: The act of making a tract of land a part of the town. Annexations are approved by town ordinance.
ANNEXATION MAP: A map showing the boundaries of a parcel of property, surveyed dimensions, and all other items required by this title.
ARTERIAL STREET: A street or road of considerable continuity that serves or is intended to serve principal traffic flow between separated areas or districts and which is the main means of access to collector street and to residential streets or the roadway site. Direct access is a minor function.
BLOCK: An area of land within a platted subdivision that is entirely bounded by streets, or a street and railroad right of way, natural barrier, or adjacent municipal corporate boundary line.
BOND, PERFORMANCE: "Performance bond" means a form of financial security.
BUILDING PERMIT: An official document or certificate issued by the town authorizing the construction, repair, or remodeling of a structure.
CLERK (TOWN): The appointed official or staff person who keeps the official records of the town.
CLUSTER DEVELOPMENT: A development designed as a complete and integrated unit in which the individual units are concentrated on the portion of the site most suitable for development, and within which prescribed minimum standards for site area, setbacks and the bulk and spacing of buildings may be modified to achieve preservation of open space areas of twenty percent (20%) or more of the total acreage, exclusive of parking and roadways.
COLLECTOR STREET: A moderate capacity roadway designed to penetrate neighborhoods from which local traffic is collected and channeled to the arterial street system.
CONDOMINIUM: A. A separate fee simple estate in an individual air space unit of a multi-unit property, together with an undivided fee simple interest in common elements.
   B.   As used in this definition:
  1. "Common elements" means the land on which a building or buildings are located, foundations, structural elements of the building, such as girders, beams, roofs, halls, columns, stairs, lobbies, entrances, and exits of such building or buildings, parking areas, storage spaces, installations to utility services, including all apparatus and appurtenances thereto, and such other community and commercial facilities as may be provided for in any declaration defining the elements of the condominium ownership.
  2. "Individual air space unit" shall consist of any enclosed room or rooms occupying all or part of a floor or floors in a building of one or more floors, to be used for residential, professional, commercial, or industrial, purposes, and which has access to a public street.
CONTIGUOUS PROPERTY: Property shall be deemed contiguous when the area sought to be annexed is contiguous with or adjacent to the annexing town. Contiguity will not be adversely affected by the existence of a platted street or alley, a public or private right of way, a public or private transportation right of way, a lake, stream, reservoir, or other natural or artificial waterway located between the annexing town and the land sought to be annexed.
COUNCIL: The duly elected governing body of the town of Bar Nunn.
CUL-DE-SAC OR DEAD END STREET: A minor street with only one outlet, which shall be terminated by a permanent turnaround.
EASEMENT: A right to use in some way the land of another, with or without compensation. Easements may include, but not be limited to, land areas necessary for a public utility company to access its equipment, streets, roads and highways, and similar rights and privileges.
ENGINEER (TOWN): The appointed licensed professional engineer of the town or the designee appointed by the mayor to serve in the absence of the town engineer.
ENVIRONMENTAL STUDY: A study to determine the existence, nature, and extent of contamination existing on properties under consideration.
FINAL PLAT: A map, plan, or other representation showing streets, parks, lots, blocks, surveyed dimensions, all other items required by this title, and all conditions placed by the council on the preliminary plat for the same land area. Final plats are adopted by resolution of the town council.
FINANCIAL SURETY: A form of security, including a cash deposit, performance bond, irrevocable letter of credit or joint certificate of deposit in an amount and form satisfactory to the town.
FREEWAY: A divided, high speed or heavily traveled street of great continuity, limited or semilimited access, used primarily as a traffic artery for intercommunication among large areas.
FRONTAGE ROAD: A minor street that is parallel with and adjacent to an arterial street, providing access to abutting properties and facilitating protection from through traffic.
LANDOWNER (OWNER): The owner of title as recorded in the office of the county clerk, or a person possessing a power of attorney and authorized to act in behalf of the owner for a specified purpose.
LETTER OF CREDIT: A form of financial surety in favor of the town. Any letter of credit, which expires, may be "cashed" by the town council or may be renewed subject to the approval of the town council. Any letter of credit, which is renewed, is subject to increase for inflation. The standard form for a letter of credit may be obtained from the town.
LOCAL STREET: A low speed, low volume street that provides direct access to abutting property and connects to collector or minor arterial streets.
LOT: A portion of a subdivision or plat of land, separated from other portions by description as on a subdivision or record of survey map or by metes and bounds, for the purpose of development or sale or lease to, or separate use of, another.
MARGINAL ACCESS/MINOR STREET: A minor street, which may or may not be parallel with and adjacent to arterial streets, providing access to abutting properties and facilitating protection from through traffic.
MASTER PLAN OR TOWN OF BAR NUNN GUIDE FOR GROWTH: The comprehensive plan prepared by zoning and planning to advise the town council and a plan which should indicate the general locations recommended for streets, public works, parks, schools, and other public improvements and open spaces, for the general development of the town. It includes any part of such plan separately adopted, and any amendments to such plan or parts thereof.
OFF SITE IMPROVEMENTS: The improvements not on a building site that are deemed necessary by the council for the health, safety, and welfare of the citizens of the town. These include, but are not limited to, streets, sidewalks, curb and gutter, streetlights, fire hydrants, storm drainage systems, water and sewer lines, and street signs.
OFFICIAL MAP: Any map established and adopted by the town council showing streets, utilities, parks, and other public improvements, and all appurtenances thereto, including amendments and additions thereto.
PUD: Planned unit development.
PARKS PLAN: Any plan adopted by the council, which specifies criteria for parks and recreation development within the town.
PAVING WIDTH: The shortest distance across any strip of paving, from the point where the paving abuts the gutter across the paving to the point on the far side where the paving abuts the gutter and shall not include any portion of the material comprising the gutter or curb.
PERIMETER PLAT: A map prepared by a Wyoming licensed surveyor, which delineates the boundaries of a parcel of property.
PERSON: Any individual person, or persons, partnership, corporation, association, or other legal entity.
PETITIONER: Any person commencing proceedings under this title to effect an annexation of land to the town, for himself or another.
PLAT OF RECORD: A map, plan or chart of any land consisting of one, two (2) or more lots, tracts or other division of land for the purpose of annexation, transfer of ownership, or for building development, prepared to scale, and on file in the office of the county clerk.
PRELIMINARY PLAT: A map that delineates the proposed streets, parks, lots, blocks, survey dimensions, and all other items required by this title. (See chapter 3 of this title for details.)
PRIVATE ROAD: A street that is privately owned and maintained for access to private property.
REPLAT: A plat that amends or changes a plat recorded in the office of the county clerk.
RIGHT OF WAY: The right to cross the real property of another person.
STORMWATER MANAGEMENT MASTER PLAN: A plan prepared for the urban area, which specifies guidelines for the control of stormwater runoff in the area surrounding the town, as adopted by the council.
STREET: A public thoroughfare, avenue, road, highway, boulevard, parkway, trail, drive, lane, or court for vehicular traffic.
STREET PLAN (INCLUDING MAP): The comprehensive plan prepared to advise the council, which specifies the locations of arterial and collector roadways for the development of the town. It includes any part of such plan separately adopted, and any amendment to such plan or parts thereof.
STREET RIGHT OF WAY WIDTH, PUBLIC: "Public street right of way width" means the shortest distance between the lines delineating the right of way of a street.
SUBDIVIDER: Any individual, person, or any other legal entity commencing proceedings under this title to effect the subdivision of land under this title, for himself or for another.
SUBDIVISION: Any division of a lot, tract, or parcel of land into two (2) or more lots, tracts or other division of land for the purpose of transfer of ownership or for building development, or, if a new street is involved, any division of land. The term includes resubdivision and relates to the process of subdividing or to the land subdivided.
TOWNHOUSE: A single-family dwelling unit constructed as part of a series of two (2) or more single-family dwelling units sharing a common vertical wall and a common lot line, which has a ground level entrance and which is located on a single, individually owned lot.
WATERCOURSE: A channel in which a flow of water occurs, either continuously or intermittently. Such flow must be in a definite direction. Watercourses may be either natural or manmade, and the former may occur on either the surface or underground. "Watercourse" is also known as "drainageway" and "waterway".
WETLAND: As defined by the United States environmental protection agency is those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs, and similar areas.
ZONING: The confining of certain classes of buildings and uses to certain localities, areas, districts, or zones, and the regulation of the height, area, bulk, location and use of private and public structures and premises, and of population density.
