6-3-15: PENALTIES:
   A.   Injunctive Relief: Pursuant to Wyoming Statutes section 15-1-103(a)(xlvi), the city, after consultation with the Town, or the city alone, may bring an action in the District Court, Seventh Judicial District, Natrona County, Wyoming, for injunctive relief against any person who violates any provision of this Chapter or any rules, regulations, orders, or permit adopted or issued under this Chapter.
   B.   Civil Penalties: In addition to being subject to an injunctive action under this Chapter, a person who violates any provision of this Chapter or of any rule, regulation, order, or permit adopted or issued under this Chapter is liable to pay a civil penalty pursuant to Wyoming Statutes section 15-1-103a(xlvi) of not less than one thousand dollars ($1,000.00) and not more than ten thousand dollars ($10,000.00) per violation per day, to be collected in a civil action.
   C.   Criminal Penalties:
      1.   Violating This Chapter, Rules, Regulations, Orders Or Permits:
         a.   A person who violates any provision of or fails to perform any provision of or fails to perform any duty imposed by a rule, regulation, order or permit adopted under this Chapter, is guilty of a misdemeanor and upon conviction is subject to a fine not exceeding seven hundred fifty dollars ($750.00) per violation per day or imprisonment not to exceed six (6) months or both.
         b.   In addition to any criminal penalties imposed on a person convicted under this subsection, the person may be enjoined from continuing the violations.
         c.   Each day on which a violation occurs is a separate violation under this subsection.
      2.   A false statements of a material fact in a required document may subject a person to a finding of guilty of a misdemeanor. Upon conviction is subject to a fine not exceeding seven hundred fifty dollars ($750.00) or imprisonment not exceeding six (6) months or both if the person:
         a.   Knowingly makes any false statement representation, or certification of a material fact in any application, record, report, plan, or other document filed or required to be maintained under this Chapter or any rule, regulation, order or permit adopted or issued under this Chapter; or
         b.   Falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method required to be maintained under this Chapter or any rule, regulation, order, or permit adopted or issued under this Chapter.
   D.   Judicial Enforcement: All actions for the remedies provided in this Chapter shall be commenced and prosecuted in the District Court for the Seventh Judicial District Natrona County, Wyoming. (Ord. 99-03, 11-16-1999)
