A. Tampering With Wastewater Facilities: No person shall maliciously, wilfully or negligently break, damage, destroy, uncover, deface or tamper with any structure, appurtenance or equipment which is a part of the wastewater facilities. Any person violating this provision shall be subject to punishment pursuant to Section 1-4-1 of this Code.
B. Harmful Contributions: The city/Town may suspend the wastewater treatment service and/or wastewater contribution permit when such suspension is necessary, in the opinion of the city, in order to stop an actual or threatened discharge which presents or may present an imminent or substantial endangerment to the health or welfare of persons, to the environment, cause interference to the POTW or causes the violation of any condition of its NPDES permit. Notice of the action taken in accordance with this subsection shall be sent to the user, (as described in definitions), by letter sent certified mail, return receipt requested, or, at the election of the city/Town, by facsimile transmission, to the address at which the billing for the service is sent. The city/Town shall receive a copy of the notice of the action taken if the user is within their boundary.
C. Suspension Order: Any user notified of a suspension of the wastewater treatment service and/or the wastewater contribution permit shall immediately stop or eliminate the contribution. In the event of a failure of the person to comply voluntarily with the suspension order, the Town or city shall take such steps as deemed necessary including immediate severance of the water and/or sewer connection, to prevent or minimize damage to the POTW system or endangerment to any individuals. The city/Town shall reinstate the wastewater contribution permit and/or the wastewater treatment service upon proof of the elimination of the noncomplying discharge. A detailed written statement submitted by the user describing the cause of the harmful contribution and the measures taken to prevent any future harmful contribution and the measures taken to prevent any future occurrence shall be submitted to the city/Town within fifteen (15) days of the date of occurrence. Said written statement shall be in form and content acceptable to the city/Town. Failure to comply with this requirement shall constitute a violation and cause for revocation of the wastewater contribution permit under this subsection. (Ord. 99-03, 11-16-1999)
