§ 610.05 DIVISION OF AIR QUALITY MANAGEMENT.
   (A)   Establishment. For the purpose of protecting the health, welfare and property of the citizens of the City of Barberton, there is hereby established a Division of Air Quality Management in the Board of Health and under the supervision and administration of the Health Commissioner. The Division of Air Quality Management shall adopt a comprehensive and integrated plan to control excessive emission of air pollutants within the corporate limits so that the resultant adverse effect upon the public health, welfare and property may be abated. It is desirable to adopt appropriate regulations to reduce air pollution caused by excessive smoke, soot, cinders, fly ash, dust, noxious gases, fumes and vapors, the emission of which is detrimental to the health, welfare and property of the residents of the city.
   (B)   Composition; appointments. The Division of Air Quality Management shall include one Administrator and such deputies and employees as may be provided for by the City Council, all of whom shall be appointed in accordance with the Charter of the City of Barberton.
   (C)   Authority of Health Commissioner. The Health Commissioner is authorized to enter into contracts with other political subdivisions of the State of Ohio and the United States Environmental Protection Agency and the Ohio Environmental Protection Agency to reconfirm the role of the Akron Regional Air Quality Management District in the enforcement of the State of Ohio air pollution control law and regulations and local air pollution control ordinances.
