§ 359.03 POWERS GENERALLY.
   The Parking Commission shall have the power in the name of the city to create, establish and operate parking facilities in accordance with the provisions of this chapter, subject to the specific authorization and approval of Council. The Commission shall have the power to recommend to Council the acquisition, by purchase, gift, devise, lease, exchange or other contract or exercise of the power of eminent domain, of real property or any interest therein necessary for or incidental to the construction, maintenance or operation of such parking facilities. The Commission, subject to approval of Council, shall have the power to engage special legal counsel and/or a special assistant to acquire the real property or any interest therein necessary for or incidental to the construction, maintenance or operation of such parking facilities. After the method of financing is established, the Commission shall, subject to the approval of Council, prepare necessary plans and drawings and construct or contract for the construction of parking facilities. The Commission shall submit necessary plans and recommend to Council the construction of, or contracting for, parking facilities; maintain and operate parking facilities; establish parking hours and reasonable off-street parking fees; establish the method of collecting the parking fees; and lease parking facilities to any individual, firm or corporation, upon such terms and conditions as the public interest may warrant; provided that, such Commission shall not dispense or furnish, or permit any lessee or occupant to dispense or furnish, upon or in connection with any property or facility acquired or operated pursuant to this chapter, any product or service other than the parking of motor vehicles.
