(A) No person shall operate a tow truck upon the streets of the city without first obtaining a license therefor from the Safety Director. Such license shall be issued for a 12-month period and expire on June 30 of each year. Application for a license shall be made by the owner on forms provided by the Safety Director. The fee shall be $35 for the first vehicle and $10 for each additional vehicle. Each owner of a tow truck shall furnish, at the time of application or renewal of such license, a certificate of insurance, or an acknowledgment thereof, by an insurance carrier licensed to do business in the state; evidence of the owner’s legal liability to protect property left in his or her care, custody or control, in an amount not less than $25,000; and general liability in an amount not less than $100,000. The city shall be an additional insured on said insurance policy. In addition, a first application and renewal shall include a photograph of both sides of each vehicle to be licensed.
(B) The provisions of this section relating to the owner’s legal liability shall not apply to tow truck owners who establish, to the satisfaction of the Safety Director, that they do not own, operate or maintain garage or vehicular storage.
