For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
LATE NIGHT GASOLINE STATION. Any person, partnership, corporation or other entity who or which sells gasoline or other petroleum fuel to the public between the hours of 1:00 a.m. and 6:00 a.m.
LATE NIGHT RETAIL ESTABLISHMENT. Any person, partnership, corporation or other entity, except grocery stores and fast food establishments, which:
(1) Derives 50% or more of its gross income from the sale of goods, merchandise or other articles of value which are intended for use off the premises; and
(2) Sells goods, merchandise or other articles of value in their original containers between the hours of 1:00 a.m. and 6:00 a.m.
PAY BOOTH. A structure within an establishment or gas station constructed of bullet-resistant windows, walls and doors. Such PAY BOOTHS and required equipment must be maintained in good working order at all times. Each PAY BOOTH must conform to the security requirements set forth in § 834.02 of this chapter.
PAY DRAWER and/or MERCHANDISE DRAWER. A through-the-wall bullet-resistant security transaction drawer or opening in an exterior wall of a building which allows a retail establishment to transact business from the establishment’s building without direct customer contact. Such PAY AND/OR MERCHANDISE DRAWER(S) shall be surrounded by bullet-resistant walls and windows. Such PAY AND/OR MERCHANDISE DRAWER(S) must be maintained in proper working order at all times.
