§ 822.12 FORFEITURES FOR NON-COMPLIANCE.
   Pursuant to 47 C.F.R. § 76.943(a), the Mayor is hereby authorized to impose a civil monetary forfeiture on any cable operator that does not comply with a rate decision or a refund order directed specifically at the cable operator. In his or her decision to impose such a forfeiture, the Mayor may consider the pendency of any appeals or legal action involving the rate decision or refund order, the amount of the refund or rate reduction and the intentional or unintentional nature of the non-compliance. Such forfeitures may be imposed pursuant to the following schedule:
   (A)   Failure to implement a rate reduction or refund within 60 days of the date of the communication to the cable operator of the written decision ordering such rate reduction or refund: $10,000; and
   (B)   Failure to implement a rate reduction or refund after 60 days of the date of the communication to the cable operator of the written decision ordering such rate reduction or refund: $1,000 per day for each day of non-compliance.
