§ 153.12 REMOVAL OF ABANDONED TOWERS OR WIRELESS SUPPORT STRUCTURES.
   Any antenna, tower or wireless support structure/facility must be removed within 180 days upon which it ceases to be in active use. Upon approval of the application to install a tower or wireless support structure/facility within the jurisdiction of the town, the applicant shall post a bond with the town equal to the present day cost of removal of the tower or wireless support structure/facility as estimated by a state-licensed general contractor employed by the town to provide such cost. If requested by the applicant, the town shall solicit three quotes from licensed contractors to establish this amount and shall apply the lowest amount provided as the amount of the performance bond. Upon the removal of the tower or wireless support structure/facility by the applicant, the bond will be refunded to the applicant. In the alternative, the applicant may post a performance bond issued through a licensed state insurance provider in the amount stated above.
