§ 153.11 CONTINUED COMPLIANCE REQUIRED.
   (A)   All permits for the erection of a tower or wireless support structure/facility are issued in reliance upon the condition that the tower or wireless support structure/facility will in fact conform to the plans that are submitted as the basis for the permit. Once erected, the tower or wireless support structure/facility must at all times be maintained in compliance with the provisions of the conditional use permit.
   (B)   To ensure the structural integrity of towers or wireless support structures/facilities, the owner of a tower or wireless support structure/facility shall ensure that it is constructed and maintained in compliance with standards contained in the applicable state building codes and the applicable standards for towers or wireless support structures/facilities that are published by the Electronic Industries Association (EIA) as amended from time to time.
   (C)   At least every 12 months, an expert who is regularly involved in the maintenance, inspection and/or erection of telecommunication towers or wireless support structures/facilities shall inspect the tower or wireless support structure/facility at the owner’s expense. At a minimum, this inspection shall be conducted in accordance with the tower or wireless support structure/facility inspection check list provided in the EIA Standard 222 Structural Standards for Steel Antenna Towers and Antenna Support Structures. A copy of such inspection record shall be forwarded to the Zoning Administrator.
   (D)   If the Zoning Administrator concludes that a tower or wireless support structure/facility fails to comply with the state’s Building Codes and/or the EIA standards and constitutes a danger to persons or property, then upon notice being provided to the owner of the tower or wireless support structure/facility, the owner shall have 30 days to bring such tower or wireless support structure/facility into compliance with such codes and standards. If the owner fails to bring such tower or wireless support structure/facility into compliance within 30 days, the Board of Adjustment may order the removal of the tower or wireless support structure/facility at the owner’s expense.
