The purpose of this chapter is to establish general guidelines and regulations governing the location, size and design of wireless communication facilities and/or telecommunication towers to be located within the town and its extraterritorial jurisdiction (ETJ) while minimizing the impacts on surrounding properties. The town encourages the use of existing buildings or permanent stationary structures to attach newer and less conspicuous wireless technology in order to provide additional telecommunications facility opportunities and preserve the unique and rustic mountain atmosphere of the town. Nothing in this chapter shall be interpreted to excuse compliance with or be in lieu of any other requirement of state or local law, except as specifically provided herein. Without limitation, the provisions of this chapter do not permit placement of wireless communication facilities on privately owned utility poles or wireless support structures, or on private property, without the consent of the property owner or any person who has an interest in the property.
