§ 50.028 METERED WATER; BROKEN WATERLINES; INOPERATIVE METER.
   (A)   Consumers using meters must have their entire water supply to the premises on which they are set metered, and they will be charged for all water that passes through the meter, whether used or wasted.
   (B)   It is the responsibility of the customer to check water and sewer lines on the property of the customer for broken or burst pipes. Each customer or user shall contact the Utility Department to report any such instance of broken or burst lines as soon as possible after discovery, and in no event no later than 15 days after the postmark date of the monthly water and sewer statement or 15 days after discovery of broken or burst lines, whichever sooner occurs.
   (C)   Upon the proper reporting and proof of repair by the customer of a broken line, the customer will be allowed a rate adjustment for any contested amount of water usage, or sewer usage, not to exceed two billing periods; however, the water rate shall be adjusted one time to each customer in a calendar year. The sewer rate may be adjusted more than one time in a calendar year.
   (D)   If the customer is so entitled, the contested monthly water bill shall be determined by averaging the previous three months water service bills to reflect an average bill for the contested amount of water usage.
   (E)   If the seal of the meter is broken by other than the town’s representatives, or in the event that the meter fails to register the use of water, the customer shall be charged with the amount computed using the appropriate following formula for the period in which the meter failed to register.
      (1)   If the customer has been an occupant at the same location for three years or more, he or she shall be charged the current rate, based upon the average water consumption for the same month during the previous years of occupancy.
      (2)   If the customer has been an occupant at the same location for less than three years, he or she shall be charged the current rate based upon the average amount of water consumed monthly.
